The purpose of this text is to explain in detail the functionalities of this website and to provide you with information relating to the owner of the website and the purpose of the content included on it. The conditions set out below are binding on any person who accesses and uses the website.

Terms of use and user obligations

The user undertakes to use the website, as well as its content and services, in accordance with applicable legislation, generally accepted practice and public policy.

The use of the website for unlawful purposes, or for purposes harmful to Divain Team SL or to third parties, or which may in any way damage, disable, overload or impair the normal operation of the site, is expressly prohibited.

Divain Team SL guarantees that the content and services offered through the portal respect the principle of human dignity, the protection of young people and children, and non-discrimination on grounds of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance.

These General Terms of Use of the site do not grant the user any intellectual or industrial property rights over the content (information, sound and image files, photographs, designs, etc.), ownership of which lies with the company or with duly authorised third parties.

Any reproduction or distribution, public communication, transformation or modification of such content is expressly prohibited, unless prior written authorisation is obtained from its legitimate owners or in the cases permitted by law.

Divain Team SL undertakes not to engage in misleading advertising and, accordingly, the following is prohibited:

Use for commercial or advertising purposes of any kind, other than those strictly permitted.

Its reproduction, publication, distribution or modification, in whole or in part, unless prior written authorisation from its legitimate owners has been obtained or unless legally permitted.

All content on this website, including but not limited to texts, images, photographs, designs, logos, distinctive signs, trade names, trade marks, models, industrial designs, structures, source code, databases, software and any other element eligible for protection, is the exclusive property of divain or is duly licensed to it, and is protected by national, EU and international intellectual and industrial property legislation. The reproduction, distribution, transformation, public communication, making available, extraction, re-utilisation or any other form of exploitation, in whole or in part, of such content without the prior express written authorisation of its owner is expressly prohibited. Access to the website does not under any circumstances entail any assignment, transfer, licence or waiver of rights on the part of its owner. You may use such material solely in the manner expressly authorised by us or by those who licensed it to us. This shall not prevent you from using this website to the extent necessary to copy information about your order or your contact details.

Third-party intellectual property

Our website offers you various search mechanisms. On our site you may find your product directly by entering the divain product you are looking for as a search term, and through the Price Comparison Tool governed by the “Price Comparison Tool” section of this Legal Notice. Our commitment is to help our customers deepen their knowledge of the world of perfume so that they can identify, describe and freely choose their favourite fragrances at the best price.

By using our website, you assume full responsibility should you type or enter third-party trade marks as search terms for our products in any of our search engines. The fact that such searches return a product of our brand as a result does not imply identity, exact reproduction, technical equivalence or objective correspondence with third-party fragrances, nor does it constitute any warranty of an identical or equivalent user experience, nor any legal or business relationship of any kind with the trade mark entered by you.

As these are products of an essentially sensory and subjective nature, such as perfumes, olfactory perception does not constitute a technical characteristic that is objectively measurable or verifiable against standardised parameters. The only element that is objectively verifiable, ascertainable and capable of direct comparison between products is price.

The products marketed under the divain brand are independent creations, developed with their own formulation, different ingredients and autonomous processes, without reproducing or seeking to reproduce the protected compositions, formulas or know-how of third parties.

Under no circumstances is there any commercial, corporate, contractual, licensing, sponsorship or association relationship between divain-brand perfumes and any third-party trade marks that you may use as a search criterion, which belong exclusively to their respective owners.

Our policy falls within the scope of lawful comparative information provided for in Article 10 of Spanish Law 3/1991 on Unfair Competition, in that it enables consumers to have useful and non-misleading references with which to make rational economic decisions, without creating a likelihood of confusion or association, or taking unfair advantage of the reputation of third-party trade marks.

Price Comparison Tool

Nature and sources of the information

The website makes a perfume Price Comparison Tool available to the user. The price information displayed comes from publicly available sources on the Internet and is purely indicative. Prices may vary from one retailer to another depending on the time of the query, the promotions and discounts in force, or the applicable shipping costs, and Divain Team SL therefore does not guarantee their accuracy or that they are permanently up to date. The user must verify the final price at the selling store before making a purchase.

Identified advertising and ranking parameters

Among the results offered, the Comparison Tool always displays a recommendation for a perfume of the DIVAIN brand, which sponsors the tool. That recommendation is advertising in nature and is identified in all cases by the wording “Sponsored link”, displayed visibly next to each recommendation, in compliance with Article 20.1 of Law 34/2002 (LSSI-CE), Article 26 of Law 3/1991 on Unfair Competition, and Article 20.1(d) of the Consolidated Text of the General Law for the Protection of Consumers and Users.

In compliance with the duty to provide information on the main parameters determining the ranking of results, it is hereby stated that the DIVAIN recommendation is due solely to its status as the sponsoring brand of the Comparison Tool, and that the remaining results are ranked by price, with no third party having paid any amount for its position in the list of results.

Classification by olfactory notes

The classification of perfumes by “notes” used by the Comparison Tool is a generic industry taxonomy, used exclusively as a tool for exploring the user’s preferences, enabling them to look for price alternatives within generic perfume categories. That classification does not define, describe or compare the specific perfumes offered as results, nor does it imply identity, equivalence or olfactory similarity between them, olfactory perception being a subjective experience that cannot be measured against objective parameters, as set out in the “Third-party intellectual property” section.

Third-party trade marks in the Comparison Tool

The trade marks entered by the user as a search criterion in the Comparison Tool belong exclusively to their respective owners. There is no connection, affiliation, licence, sponsorship or commercial or corporate relationship whatsoever between DIVAIN and those trade marks. The only objectively verifiable characteristic compared between the products displayed is their price, within the framework of the lawful comparative information provided for in Article 10 of Spanish Law 3/1991 on Unfair Competition.

Notification of intellectual property infringements

Should a user or a third party consider that their legitimate intellectual property rights have been infringed by the inclusion of particular content on the website, they must notify Divain Team SL of that circumstance, stating:

The details of the owner of the allegedly infringed rights or, where the claim is submitted by a third party other than the rights holder, an indication of the capacity in which they are acting.

Identification of the content protected by intellectual property rights and its location on the website, evidence of the intellectual property rights invoked, and an express statement in which the interested party accepts responsibility for the accuracy of the information provided in the notification.

This site provides links to other websites of its own and to content owned by third parties.

The sole purpose of the links is to give the user the possibility of accessing them. Divain Team SL accepts no responsibility whatsoever for the outcomes that may arise for the user from accessing such links.

Any user intending to set up a technical linking device from their website to the portal must obtain the prior written authorisation of Divain Team SL. The establishment of a link does not in any case imply the existence of a relationship between Divain Team SL and the owner of the site on which the link is placed, nor the acceptance or approval by Divain Team SL of its content or services.

The website on which the link is placed shall not contain any trade mark, name, logo, slogan or other distinctive sign belonging to Divain Team SL, other than those expressly authorised.

Unilateral modification and duration

Divain Team SL reserves the right to modify, at any time and without prior notice, the presentation and configuration of the website as well as this Legal Notice.

Exclusion of warranties and liability

Divain Team SL does not guarantee the availability, continuity or proper functioning of the website, and shall under no circumstances be liable for damage or loss of any nature that may arise from:

The lack of availability, maintenance and effective operation of the Internet access service, or interruptions of the Internet network, or any other reason beyond its control.

The presence of viruses or malicious or harmful programs in the content.

Unlawful, negligent or fraudulent use of the website, its services or content by users, or use contrary to these conditions, to good faith, to generally accepted practice or to public policy.

All of the foregoing is without prejudice to the rights which consumer protection legislation grants, on a non-waivable basis, to any user having such status.

Processing of personal data

As set out in its “Privacy Policy”, which is available on this website, Divain Team SL has adopted security levels appropriate to the data it processes and manages, implementing all the technical means and measures at its disposal to ensure its confidentiality and to prevent its misuse, loss, alteration, unauthorised access and theft.

Applicable law and jurisdiction

Spanish law shall apply to the resolution of all disputes or matters relating to this website or to the activities carried out on it, and the parties expressly submit thereto. The Courts and Tribunals of the domicile of any user having consumer status shall have jurisdiction, in accordance with Article 90.2 of the Consolidated Text of the General Law for the Protection of Consumers and Users; in relations between businesses, the Courts and Tribunals of the city of Madrid (Spain) shall have jurisdiction.
